ERPO Laws Are Already in Effect in California, Connecticut, Oregon and Washington State

After every shooting incident the Democrats immediately start complaining about the frequency of gun violence in our nation, then they start to push their gun control legislation.

Gun control advocacy organization have been pressuring Congress to complete their goal of reducing gun violence by confiscating the guns from the citizens. If that happens it will be unconstitutional but also will stimulate a civil was. So the gun control groups, for now, are just pushing a limited confiscation of firearms from certain persons, and they have huge support from mainstream media to achieve their goal.

ABC News issued an article about the gun control implement known as Extreme Risk Protection Order, this is basically a restraining order the gun owners and their firearms, this will authorize the confiscation of the gun on simple say-so basis from others like family members, friends or law enforcement officials.

ERPO laws are already existing in states as Connecticut, California, Washington state, and Oregon, with similar laws being created in states like Indiana and Texas.

These laws authorize the family members or law enforcement officers to express their worry about the potential danger of a person owning a gun in a petition to a judge, who can order the person to give away his lawfully possessed guns for some period of time.

Breitbart noted that these orders are created “ex parte” behalf of one party in the absence of the other, this means that the person will find out about the ERPO against him when the police will show up to his door and confiscate his weapons.

Also, the ant-gun groups frequently mispresent and twist the numbers about the “gun violence” to gather a support from the people and the legislators regarding their confiscation orders.

The NRA said that they do not approve of such confiscation measures.

In Sept. 2016 when Washington voters were getting ready to vote on a ballot about ERPO the NRA pointed out that people with no expertise in mental health could only violate the persons constitutional right possess firearms.

“This law would be ripe for abuse by individuals that disagree with the Second Amendment, and the mere insinuation that gun ownership makes you a danger to yourself or others is offensive and insulting,” the NRA stated.

The NRA also criticized the signing of ERPO laws in Oregon by expressing their concerns with this confiscation laws.

The new law in Oregon “will allow people who are not mental health professionals, who may be mistaken, and who may only have minimal contact with the respondent to file a petition with the court and testify on the respondent’s state of mind.”

“This ex parte order, which strips the accused of their Second Amendment rights, will be issued by a judge based on the brief statement of the petitioner,” the NRA stated. “The accused will not be afforded the chance to appear in court to defend themselves against the allegations when the ERPO is issued.”

“These orders may be issued without any allegations of criminal behavior.”
